These Terms of Service ("Terms") govern your access to and use of the website, client portals, and services provided by St George's Investigative Services, doing business as AZ Truthfinder ("AZ Truthfinder," "we," "us," or "our"). By accessing or using our site or services, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree, do not use our services.

1) Services and Scope

AZ Truthfinder provides investigative, verification, and information services for individuals, employers, and law firms (collectively, "Clients"). Our services may include research, record retrieval, interviews, on-site verification, and preparation of written findings ("Deliverables"). We do not provide legal advice. Clients are responsible for their own legal review and decisions.

2) Lawful Use and Client Responsibilities

  • You will request and use our services only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to privacy, employment, consumer protection, data protection, and surveillance laws.

  • You will not use our services to stalk, harass, defame, doxx, discriminate, or otherwise infringe the rights of any person.

  • If your matter involves employment-related background screening or consumer reports subject to the Fair Credit Reporting Act (FCRA) or similar laws, you agree to notify us in advance. Unless expressly agreed upon in writing, AZ Truthfinder does not act as a "consumer reporting agency," and our Deliverables are not considered "consumer reports."

  • You are responsible for obtaining all required consents, authorizations, and disclosures from subjects, and for providing us with accurate and complete information necessary to perform the services.

3) Accounts and Client Portals

You may be required to create an account to access client portals. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use or security incident.

4) Orders, Fees, and Payment

  • Quotes or order confirmations will specify scope, fees, and estimated timelines. Additional requests or scope changes may incur additional fees.

  • Unless otherwise stated, fees are due upon receipt. Fees are non-refundable once work has begun.

  • Expenses such as official record fees, travel, rush services, and third-party costs may be billed to the Client with prior notice.

  • All amounts are in U.S. Dollars and exclusive of taxes. Client is responsible for applicable taxes.

5) Cancellations, Refunds, and Changes

  • Due to the customized nature of investigative work, fees are generally non-refundable once work has begun. We will act reasonably to accommodate cancellations or rescheduling requests made before work begins.

  • If third-party costs have been incurred on your behalf, those amounts are non-refundable.

  • Material scope changes require written confirmation and may result in adjustments to pricing and timelines.

6) Deliverables and Use Rights

  • Subject to full payment, we grant you a non-exclusive, non-transferable license to use Deliverables for your internal, lawful purposes as specified in the order.

  • You may not resell, republish, or distribute Deliverables except as reasonably necessary to your matter (e.g., to your counsel) and subject to confidentiality obligations.

  • We may use anonymized, aggregated insights to improve our services, provided that no personal information is disclosed in violation of our Privacy Policy.

7) Confidentiality and Data Protection

  • Each party will protect the other's confidential information with reasonable care and use it only for the purpose of performing or receiving the services in question.

8) Compliance and Cooperation

  • You agree to cooperate with reasonable requests needed to perform the services (e.g., verifying authority, providing documents, clarifying scope).

  • We may decline or terminate services if lawful authority is not established or if we reasonably believe the request is unlawful or poses a safety risk.

9) Timelines and Access Limits

Timelines are estimates. Access to records and information may be dependent on third-party systems, legal constraints, and factors outside our control. We are not liable for delays caused by third parties or authorities.

10) Warranties and Disclaimers

  • We will perform services in a professional and workmanlike manner consistent with industry standards.

  • Except as expressly stated in these Terms, the services and site are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

11) Limitation of Liability

  • To the maximum extent permitted by Law, neither party will be liable for any indirect, incidental, consequential, special, or punitive damages, or lost profits, even if advised of the possibility.

  • Our total liability arising out of or related to the services will not exceed the amounts paid by you to us for the specific order giving rise to the claim in the twelve (12) months preceding the event.

12) Indemnification

You agree to defend, indemnify, and hold AZ Truthfinder and our officers, employees, and contractors harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your unlawful or improper use of the services or Deliverables; or (c) your failure to obtain required consents or provide required notices or disclosures.

13) Intellectual Property

We retain all rights, title, and interest in and to our methodologies, processes, software, templates, and pre-existing materials. No rights are granted except as expressly stated.

14) Suspension and Termination

We may suspend or terminate access to the site or services immediately if you breach these Terms, if payment is overdue, or if we reasonably believe your use is unlawful or poses a risk. You may terminate services at any time, subject to Section 5 regarding refunds.

15) Dispute Resolution; Governing Law

  • These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

  • Venue and jurisdiction for any permitted court action will be in state or federal courts located in Maricopa County, Arizona.

  • At our election, disputes may be resolved by binding arbitration administered by a recognized arbitration provider in Arizona, with one arbitrator, and in English. Each party bears its own costs; fees may be allocated by the arbitrator.

16) Changes to the Services or Terms

We may modify the services or these Terms at any time. Changes are effective when posted to the site with an updated Effective Date. Your continued use after changes constitutes acceptance.

17) Third-Party Tools and Links

Our site may include links or integrations with third-party tools (e.g., analytics, payment processors). Those are governed by the third party's terms and policies. We are not responsible for third-party services.

18) Notices

We may send notices by email to the address associated with your account or by posting on the site. You may send legal notices to info@aztruthfinder.com or by mail to P.O. Box 6872, Chandler, AZ 85246, USA. Electronic communications satisfy any legal requirement that such communications be in writing.

19) Force Majeure

Neither party is liable for delay or failure to perform due to causes beyond its reasonable control, including acts of God, government actions, labor disputes, cyber incidents, or failures of third-party systems.

20) Entire Agreement; Order of Precedence

These Terms, together with any order forms, statements of work, and our Privacy Policy, constitute the entire agreement between you and AZ Truthfinder regarding the services and supersede prior discussions. If there is a conflict, the order form or statement of work takes precedence over these Terms.

21) Severability; Waiver; Assignment

If any provision is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or asset transfer.
